These terms govern the use of Sahabat's website and the arrangements we provide to families in Penang. By contacting us, using our website, or entering into an arrangement, you agree to these terms.

1. Definitions
Throughout these Terms, the following words have the meanings given below:
- "Sahabat", "we", "us", "our" — refers to the home support provider operating under the name Sahabat, based at No. 8, Jalan Kelawai, 10250 George Town, Pulau Pinang.
- "You", "the client", "the family" — refers to the individual or family contacting Sahabat or entering into an arrangement.
- "Arrangement" — refers to any of the three home support packages offered by Sahabat: Daytime Companionship Programme, Daily Living Support Coordination, or Home Comfort & Accessibility Setup.
- "Website" — refers to the Sahabat website accessible at sahaba.live.
- "Agreement" — refers collectively to these Terms and any written or verbal confirmation of an arrangement between you and Sahabat.
2. Acceptance of Terms
By using our website, submitting an enquiry, or entering into an arrangement, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding agreement.
- You have read, understood, and agree to be bound by these Terms.
If you are entering into an arrangement on behalf of another person (such as an older relative), you confirm that you have the authority to do so.
3. Our Services
Sahabat provides home companionship and support coordination for older relatives in Penang, Malaysia. Our three arrangements are:
- Daytime Companionship Programme — structured daytime visits, activity planning, and end-of-day family notes.
- Daily Living Support Coordination — household task coordination, laundry, meal preparation assistance, and helper management.
- Home Comfort & Accessibility Setup — room layout consulting, written recommendations, and one follow-up review.
All arrangements are available to families in Penang Island. Availability for Seberang Perai and surrounding areas is subject to confirmation. We do not provide medical, nursing, or clinical care of any kind. Our work is non-medical and focused on companionship, household coordination, and home environment consulting.
4. Your Responsibilities
When working with Sahabat, you agree to:
- Provide accurate and complete information about the household and the person being supported.
- Inform us of any changes in the older relative's circumstances that may affect the arrangement.
- Ensure that the home environment is reasonably safe for our team members who visit.
- Not ask Sahabat staff or companions to carry out tasks outside the agreed scope of the arrangement.
- Use the website only for lawful purposes and not attempt to interfere with its operation.
5. Arrangement Terms
Scope: The scope of each arrangement is agreed before the arrangement begins and set out in writing. Changes to scope should be discussed and confirmed before being implemented.
Scheduling: Session days and times for the Daytime Companionship and Daily Living Support arrangements are agreed at the outset. Where scheduling changes are needed, reasonable advance notice is expected from both parties.
Cancellations: Where a scheduled visit cannot proceed due to circumstances on your side, please notify us as early as possible. We will make reasonable efforts to reschedule where practicable.
Non-medical scope: Sahabat does not provide medical advice, medication administration, clinical assessments, or emergency response services. If the situation of the older relative requires medical attention, we will encourage and support the family to seek appropriate professional help.
Confidentiality: We treat information about your family and your older relative with care and discretion. Our team members are expected to maintain confidentiality with respect to all households they serve.
6. Payment
Currency: All prices are stated in Malaysian Ringgit (RM).
Pricing: Current pricing for each arrangement is listed on our website and confirmed at the start of each engagement. Prices are subject to change with reasonable notice.
Payment timing: Payment terms are agreed individually with each family and confirmed in writing before the arrangement begins. Standard terms are payment in full at the start of the arrangement period.
Payment methods: We accept bank transfer and cash. Other methods may be discussed on request.
Refunds: If an arrangement is cancelled before it begins, a refund will be issued less any reasonable costs already incurred in preparation. Once an arrangement has begun, refunds for unused portions will be considered on a case-by-case basis and at our reasonable discretion. We aim to be fair and consider each family's circumstances.
7. Intellectual Property
All content on the Sahabat website — including text, layout, images, and branding — is owned by or licensed to Sahabat. You may not reproduce, copy, distribute, or use this content for commercial purposes without our written permission. Nothing in these terms grants you any rights to our intellectual property beyond what is necessary to use the website as intended.
8. Disclaimers
Our website and services are provided in good faith. We do not warrant that:
- The website will be available without interruption or error at all times.
- Any particular outcome or result will follow from our arrangements.
- Information on the website is free from inaccuracies at all times, though we aim to keep it current.
Nothing we say or write should be taken as medical, therapeutic, or clinical advice. Families requiring professional health or social care assessment should seek qualified practitioners.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Sahabat's total liability to you arising from or in connection with an arrangement shall not exceed the amount paid by you for that arrangement.
We shall not be liable for:
- Indirect, consequential, or incidental losses.
- Events beyond our reasonable control (force majeure), including but not limited to illness, extreme weather, or public emergencies.
- Losses arising from inaccurate or incomplete information provided to us by you.
10. Indemnification
You agree to indemnify and hold Sahabat harmless from any claims, damages, or costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of our website or services.
11. Termination
By either party: Either party may bring an arrangement to an end by providing reasonable written notice. The notice period required is agreed at the outset and will be stated in the arrangement confirmation.
By Sahabat: We may end an arrangement immediately if we believe continuing would put our team members at risk, or if the terms of the arrangement have been materially breached.
Effect of termination: Upon termination, any sums already paid will be reviewed in line with the refund terms in Section 6. Sections relating to intellectual property, limitation of liability, and dispute resolution survive termination.
12. Dispute Resolution
Governing law: These Terms are governed by the laws of Malaysia. Any dispute will be subject to the jurisdiction of the courts of Penang, Malaysia.
Informal resolution: Before pursuing formal action, we ask that both parties make a genuine effort to resolve disagreements directly. Most concerns can be addressed quickly through a straightforward conversation. Contact us at [email protected].
Mediation: Where informal resolution is not possible, the parties may agree to refer the dispute to mediation through the Malaysian Mediation Centre before pursuing litigation.
13. General Provisions
Entire agreement: These Terms, together with any written arrangement confirmation, constitute the entire agreement between you and Sahabat with respect to the matters described.
Severability: If any provision of these Terms is found to be unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full effect.
No waiver: A failure on our part to enforce any provision does not constitute a waiver of our right to do so in the future.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations in the event of a business transfer, with notice to you.
Notices: Formal notices under these Terms should be sent by email to [email protected] or by post to our registered address.
14. Changes to These Terms
We may update these Terms from time to time. When we do, the "Last updated" date at the top of this page will be revised. Where changes are material, we will make reasonable efforts to inform families with active arrangements. Continued use of our website after the effective date of a revision constitutes acceptance of the updated Terms.
